The Regulation respecting the distribution of information and the protection of personal information requires all organizations governed by the Act respecting Access to documents held by public bodies and the Protection of personal information (R.S.Q., c. A-2.1) to publish certain information on their website.
Since the Directeur de l’état civil has its own website, some of the documents concerned by the Regulation can be found there. To access documents whose distribution is compulsory under the Regulation other than those available on the Directeur de l’état civil website, we invite you to use the hyperlink to the documents of the Regulation on the Services Québec website.
While having to comply with the provisions of the Act respecting Access to documents held by public bodies and the Protection of personal information, the Directeur de l’état civil must also conform to the Civil Code of Québec, which governs the holding, safeguarding and publication of registers that are not governed by the Act respecting Access (s. 2).
The register of civil status contains information regarding births, marriages, civil unions and deaths that occurred in Québec or concerns persons domiciled there. When a request for a civil status document (certificate, copy of an act or attestation) is made, the register is consulted based on the provisions of the Civil Code of Québec. Otherwise, this information is not available for consultation without special permission from the registrar of civil status, granted only in certain specific situations under section 150 of the Civil Code of Québec.
The register of officiants is a data bank containing the names of authorized marriage and civil union officiants. Its purpose is to ensure that persons chosen to solemnize a marriage or civil union are authorized to do so by the registrar of civil status.
For any request regarding the information contained in the register for birth, marriage, civil union or death, citizens must file a request with the Directeur de l’état civil by referring to the description of services offered by the Directeur de l’état civil and related forms.
For any request involving information not contained in the register, citizens should forward their access request to the person responsible for access to documents and protection of personal information at Services Québec.
Note that if a request is not addressed to the right person, it will be forwarded correctly immediately.
